No, universities in India cannot operate without the approval of the UGC. Private universities have been approved by the UGC. They can confer degrees but not establish off-campus affiliated colleges. They may, however, open off-campus centres in the appropriate state after five years of operation and with prior clearance from the University Grants Commission.

The University Grants Commission is an Indian government-run organisation established in accordance with the UGC Act 1956. No university can establish colleges without the consent of the UGC. If a university is not approved by the UGC, it is deemed unlawful or fraudulent. No university can run colleges without the consent of the UGC. Your degree is regarded invalid if it was obtained from an unapproved university. Students must check for UGC authorization before enrolling in any university; otherwise, their degree would be invalid.

However, The University Grants Commission does not specify diploma/certificate programmes. Universities, on the other hand, can provide diploma and certificate programmes with the agreement of their respective governing bodies/statutory councils. Source
